Social Media Login Data

We may provide you with the option to register using your existing social media account details (e.g., Facebook, X, or similar). If you choose to do so, we will collect certain profile information about you from the social media provider, as described in Section 7 — HOW DO WE HANDLE YOUR SOCIAL LOGINS?.

All personal information you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information Automatically Collected

In Short: Some information (like your IP address and/or browser/device characteristics) is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (such as your name or contact information) but may include device and usage details, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services, as well as for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

Log and Usage Data: Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings, and details about your activity in the Services (e.g., date/time stamps, pages and files viewed, searches, features used), device event information (system activity, error reports like “crash dumps,” hardware settings), and more.

Location Data: Information about your device’s location, either precise or imprecise. How much we collect depends on your device settings. For instance, we may use GPS and other technologies to collect geolocation data indicating your current location (based on IP address). You can opt out of allowing us to collect this information by refusing access or disabling Location settings on your device, though certain features of the Services may be unavailable if you do so.

Information Collected from Other Sources

In Short: We may collect limited data from public databases, marketing partners, social media platforms, and other external sources.

To enhance our ability to provide relevant marketing, offers, and services to you (and to keep our records updated), we may obtain information about you from various third-party sources. These could include public databases, joint marketing partners, affiliate programs, data providers, and social media platforms. Examples of such information might include mailing addresses, job titles, email addresses, phone numbers, Internet Protocol (IP) addresses, social media profiles, and user behavior data, which may be used for targeted advertising and event promotions.

If you interact with us on a social media platform using your social media account (e.g., Facebook or X), we may receive personal information about you from those platforms—such as your name, email address, or other profile data. You have the right to withdraw your consent to our processing of such personal information at any time (see Section 12 — WHAT ARE YOUR PRIVACY RIGHTS?). The specific information we receive depends on your social media account’s privacy settings. Please note that the social media platform’s use of your information is not governed by this Privacy Policy.

13. To save or protect an individual’s vital interest.

We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law—such as your consent, to comply with legal obligations, to provide you with services, to fulfill contractual obligations, to protect your rights, or to further our legitimate business interests.

If You Are Located in the EU or UK

Under the General Data Protection Regulation (GDPR) and UK GDPR, we are required to explain the valid legal bases we rely on to process your personal information. As such, we may rely on the following legal bases:

1. Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time; see Section 12 — WHAT ARE YOUR PRIVACY RIGHTS? for details on how to do so.

2. Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request before entering into a contract with you.

3. Legitimate Interests. We may process your information where we believe doing so is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests or fundamental rights and freedoms. For example, we may process personal information for the following purposes:

• Sending users information about special offers and discounts on our products or services

• Developing and displaying personalized and relevant advertising content for our users

• Analyzing how our Services are used so we can improve user engagement and retention

• Supporting our marketing activities

• Diagnosing problems and/or preventing fraudulent activities

• Understanding how our users interact with our products and services so we can improve user experience

4. Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations (e.g., cooperating with a law enforcement body or regulatory agency, defending our legal rights, or disclosing your information as evidence in litigation in which we are involved).

5. Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or those of a third party (e.g., situations involving potential threats to the safety of any person).

If You Are Located in Canada

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a particular purpose, or where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time (see Section 12 on withdrawing consent).

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

• If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way

• For investigations and fraud detection or prevention

• For business transactions, provided certain conditions are met

• If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim

• For identifying injured, ill, or deceased persons and communicating with next of kin

• If we have reasonable grounds to believe an individual has been, is, or may be a victim of financial abuse

• If obtaining consent would compromise the availability or accuracy of the information, and collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of Canadian law

• If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to production of records

• If it was produced by an individual in the course of their employment, business, or profession, and the collection is consistent with the purposes for which the information was produced

• If the collection is solely for journalistic, artistic, or literary purposes

• If the information is publicly available and is specified by regulations

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in the specific situations described below and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers

We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to certain information to do that work. We have contracts in place with these third parties to help safeguard your personal information. This means they:

• Must only process your personal information as instructed by us;

• Cannot share your personal information with any organization other than us;

• Are required to protect the data they hold on our behalf and retain it only for the period we instruct.

The categories of third parties with whom we may share personal information include, but are not limited to:

Website Hosting Service Providers

Social Networks

Sales & Marketing Tools

Payment Processors

Data Analytics Services

We May Also Share Your Personal Information in the Following Situations

1. Business Transfers

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

2. When We Use Google Maps Platform APIs

We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). Google Maps relies on GPS, Wi-Fi, and cell towers to estimate your location. Although GPS is typically accurate to about 20 meters, Wi-Fi and cell towers help improve accuracy when GPS signals are weak—especially indoors. This location data helps Google Maps provide directions but is not always perfectly precise.

3. Affiliates

We may share your information with our affiliates, and we will require them to honor this Privacy Policy. Affiliates include our parent company, subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

4. Business Partners

We may share your information with our business partners to offer you certain products, services, or promotions.

5. Other Users

When you share personal information (for example, by posting comments, contributions, or other content to the Services) or otherwise interact with public areas of the Services, such personal information may be viewed by all users and could become publicly available outside the Services indefinitely. If you interact with other users of our Services and register through a social network (e.g., Facebook), your contacts on that social network will see your name, profile photo, and descriptions of your activity. Similarly, other users of our Services will be able to view any descriptions of your activity, communicate with you, and view your profile.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to or who may advertise on our Services, but who are not otherwise affiliated with Fact Check Food.

The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us, which may link to other websites, services, or applications. Accordingly, we make no guarantees regarding any such third parties, and we will not be liable for any loss or damage caused by your use of such third-party websites, services, or applications. The inclusion of a link to any third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites; any data collected by third parties is not covered by this Privacy Policy. We are not responsible for the content or privacy/security practices of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly with any questions.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (e.g., web beacons, pixels) to gather information when you interact with our Services. Some online tracking technologies help maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit certain third parties and service providers to use online tracking technologies on our Services for analytics and advertising purposes. This includes helping manage and display advertisements, tailoring them to your interests, or sending reminders based on your engagement. These third parties and service providers use their technology to offer advertising about products and services that may align with your interests, which may appear on our Services or on other websites.

If, under applicable U.S. state laws, these online tracking technologies are considered a “sale” or “sharing” of personal data (which can include targeted advertising), you can opt out by submitting a request as described under Section 14 — DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?.

Specific information about how we use such technologies, and how you can refuse certain cookies, is provided in our Cookie Policy at https://factcheckfood.com/cookie-policy.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using details from your third-party social media account (e.g., Facebook or X). If you choose to do so, we will receive certain profile information about you from the social media provider. The specific profile information we receive may vary by provider but could include your name, email address, friends list, profile picture, and any other information you choose to make public on such a platform.

We will use the information we receive only for the purposes described in this Privacy Policy or as otherwise made clear to you within our Services. Please note that we do not control—nor are we responsible for—other uses of your personal information by the relevant social media provider. We recommend reviewing their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their respective sites and apps.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see Section 4 — WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?), located in the United States and potentially other countries.

If you are a resident of the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, please note that these countries may not necessarily have data protection laws as comprehensive as those in your own. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Policy and applicable law.

European Commission’s Standard Contractual Clauses:

We have implemented measures to protect your personal information, including the use of the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require that all recipients protect any personal information processed from the EEA or UK in accordance with European data protection laws. Our Data Processing Agreements, which include Standard Contractual Clauses, are available here:

https://factcheckfood.com/data-processing-agreement

We have also implemented similar appropriate safeguards with our third-party service providers and partners, and further details are available upon request.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required by law.

We will only retain your personal information for as long as is necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law (e.g., for tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information longer than the period in which users maintain an account with us.

When we no longer have an ongoing legitimate business need to process your personal information, we will either delete or anonymize the data. If this is not possible (for instance, if your data is stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion becomes feasible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed 100% secure. Therefore, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will never be able to defeat our security measures or improperly collect, access, steal, or modify your information.

While we do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect or solicit data from, or market to, children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to such minor’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under the age of 18, please contact us at [email protected].

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the US or in certain regions (e.g., the EEA, UK, Switzerland, and Canada), you may have rights that allow you to access and control your personal information. You may review, change, or terminate your account at any time, subject to the laws of your country, province, or state.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right to:

1. Request access and obtain a copy of your personal information

2. Request rectification or erasure

3. Restrict the processing of your personal information

4. If applicable, request data portability

5. Not be subject to automated decision-making

In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us using the details provided in Section 17 — HOW CAN YOU CONTACT US ABOUT THIS NOTICE?.

We will consider and act upon any request in accordance with applicable data protection laws.

EEA or UK Residents: If you believe we are unlawfully processing your personal information, you have the right to complain to your Member State data protection authority or UK data protection authority.

Switzerland Residents: You may contact the Federal Data Protection and Information Commissioner.

Withdrawing Your Consent

If we rely on your consent to process your personal information (which may be express or implied, depending on applicable law), you have the right to withdraw that consent at any time. You can do so by contacting us using the details in Section 17, or by updating your preferences where applicable.

Please note that withdrawing your consent will not affect the lawfulness of any processing conducted before the withdrawal. Where permissible by law, withdrawing consent will also not affect processing carried out on other lawful grounds besides consent.

Opting Out of Marketing and Promotional Communications

You can unsubscribe from our marketing and promotional communications at any time by clicking the “unsubscribe” link in our emails, or by contacting us using the details in Section 17. After unsubscribing, you may still receive service-related messages (e.g., account or security updates, responses to support inquiries) necessary for the administration of your account.

Account Information

If you would like to review or change the information in your account or terminate your account, you can:

• Log in to your account settings and update your user account.

• Contact us using the information provided in Section 17.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, or comply with applicable legal requirements.

Cookies and Similar Technologies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to remove or reject cookies; however, doing so may affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services.

If you have questions or comments about your privacy rights, you may email us at [email protected].

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. Currently, there is no uniform technology standard for recognizing and implementing DNT signals, and as such, we do not respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

California law requires us to disclose how we respond to web browser DNT signals. Because there is no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

14. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you, as well as how we have processed it. You may also have the right to correct inaccuracies, obtain a copy of, or delete your personal information, and you may withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

Categories of Personal Information We Collect

We have collected certain categories of personal information in the past twelve (12) months, as described in Section 1 — WHAT INFORMATION DO WE COLLECT?. We only collect sensitive personal information (as defined by applicable privacy laws) for permitted purposes under the law or with your consent. Sensitive personal information may be used or disclosed to a service provider or contractor for additional, specified purposes. You may have the right to limit the use or disclosure of your sensitive personal information. • Receiving assistance through our customer support channels

• Participating in customer surveys or contests

We have not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. The categories of third parties to whom we disclosed personal information for a business or commercial purpose are listed in Section 4.
